Her name was Patience. Was she beautiful? No portraits or pictures exist, but she must have been a beautiful person. Was she rich? No records have been found to indicate that she owned land or property. She wasn't educated, as she signed her mark "V" but she had some sense as the court allowed her to administer her husband's estate and she was smart enough to leave a will. Only the winds of history know her name and her lineage, but her descendants are many.
It appears she was a young girl when she married and started a family; and with at least two small children, her husband died. About the time of the administration of his estate, she was wisked again into matrimony. Two more children were born when fate made her a widow again. Patience married once more to a man possibly ten years her junior (maybe she was beautiful). She raised her children to know their heritage and probably played a part to ensure they retained their father's properties. Patience had to endure the deaths of her children and apparently raised her grandchildren and even some of her great grandchildren....always a mother.
Living into her 80's, Patience survived her third husband and several of her children. The only thing she left as a clue was her will, where she named surviving children and grandchildren. From her will the leap is made that she was the wife of these three men and the mother of their children. Her descendants remained in Northampton and Accomack or carried the three surnames to early Worcester & Somerset, Maryland, Isle of Wight, Virginia, Delaware, Kentucky and possibly Indiana. For generations, her children and their children used particular family names (Rose, Margaret, Esme) and remembered her with daughters named Patience. This project originally began and started to come together based on the use by these families of the odd given name, Esme. With it's various spellings (Ismae, Ismay, Isma, Esme), it is probably a offshoot of the name Ishmael.

1. Patience1 "V" (Fisher, Wainhouse, Marshall) was born about 1682. Patience died before November 8, 1768 in Northampton Co., VA.
She married three times. She married Thomas Fisher in Northampton Co., VA, about 1697. Thomas was born in Northampton Co., VA about 1664. Thomas was the son of Phillip Fisher (Capt.) and Elizabeth Maddux. Thomas died 1709 in Northampton Co., VA. In his will dated September 11, 1680, probate November 1, 1683, Edmund Kelley left a cow calf to Thomas, son of Thomas Maddox, and named godson Thomas, son of Phillip Fisher and left him a cow calf. Patience was named administrator for his estate for herself and the children on May 28, 1709. (James H. Marshall, Wills & Admin. Northampton Co., VA, p. 179) Maddox Fisher is the only proved child of Thomas Fisher. From the 1709 administration and use of the term "children," we know there was at least one more. Tabitha, wife of John Johnson, may have been a daughter. Thomas' wife, Patience, left a will as Patience Marshall in 1765, in which she named grandson (great grandson) Esme Bayly, grandson Hezekiah Tilney, two daughters, Patience and Margaret, and sons Esme and Thomas John Marshall; Thomas Fisher Sr. (her grandson) was an executor along with her sons Esme & Thomas John Marshall. Patience had many grandchildren at the time of her death, but did not name them in her will.
She married Francis Wainhouse in Northampton Co., VA, before April 28, 1709. Francis was the son of Francis Wainhouse. Francis died 1717 in Northampton Co., VA. She married Thomas Marshall (Mjr.) in Northampton Co., VA, about 1718. Thomas was born in Northampton Co., VA 1692. Thomas was the son of John Marshall and Sarah (N) (wife of John Marshall). Thomas died before January 19, 1760 in Northampton Co., VA. A Thomas Marshall was testator to the will of Alexander Maddux on April 10, 1717, Somerset County, MD. This was probably Thomas d. 1760 of Northampton, as the Thomas d. 1786 of Somerset was a small boy in 1717. From the other witnesses to Maddux' will, although it was recorded in Somerset County, it may have been witnessed in Northampton County. It does not appear that Thomas Marshall was in Somerset in 1717 or a relationship, if any, to Alexander Maddux is not known other than being a near neighbor to Maddux' Northampton property.
Thomas Marshall was a member of the House of Burgesses from the Eastern Shore, Northampton County, 1723-1734. (research of C. Hayward Marshall Sr. and W. Marshall Scott)
1752, Thomas Marshall of Northampton Co. VA, appointed administrator of estate of Elisabeth Dashiell, widow of Col. George Dashiell, of Somerset Co. MD. (research of Vernon L. Skinner) Elizabeth Dashiell is mother of George Dashiell, Jr., who married Thomas' step-great granddaughter, Rose Fisher. She was the widow of James Fairfax d.c. 1739. Thomas Marshall had been a witness to the will of James Fairfax. Rose Fisher (who would marry George Dashiell, Jr.) was only 7 years old, so the relationship of Thomas Marshall to Elizabeth Fairfax Dashiell existed prior to the marriage of Rose and George Dashiell, Jr. Rose Fisher & George Dashiell, Jr. name a son, James Fairfax Dashiell. George Dashiell was named next of kin in prerogative court for the estate of Thomas Marshall in 1761. Circumstantially, it appears Elizabeth Fairfax Dashiell is Thomas' sister.
Thomas' will was filed both in Northampton County, VA and Somerset Co., MD. William Allen (his son-in-law) was a creditor and was probably in Somerset at the time and this may be at least one reason by his will was filed in Maryland. That Thomas owned any land in Somerset has not been identified. Thomas' son, Esme, was in Worcester County in 1760 and his son, Thomas John, was in Dorcester.
Thomas' will was dated January 19, 1760, Northampton County, VA, and proved March 10, 1761. It appeared in both Northampton Co., VA and in Somerset Co. MD. Patience was a defendant in a court case in Northampton Co., VA, 1710. According to Purse & Person and Whitelaw, Patience married 1st Thomas Fisher (See the Fisher Family Journal) and 2nd Francis Wainhouse. With the following information, compelling evidence is given that Patience married 3rd Thomas Marshall. In her will, probated November 8, 1765, Patience Marshall named her daughter Margaret (Wainhouse) Haggoman, a child of Francis Wainhouse named in his 1717 will. Margaret married first Joachim Michael and William Haggoman second.
September 28, 1710, Court, Northampton Co., VA: this day the action of the case between Alexander Bagwell and Francis Wainehouse as marrying Patience Fisher executors of Thomas Fisher deceased defendant being called in July Court last and by consent of both plantiff and defendant...judgement is granted by the plantiff against the defendant for the sum of 400 pounds of tobacco to be paid out of the estate of Thomas Fisher deceased with cost of suit. Thomas Marshall was named guardian to Francis and Margaret Wainhouse, for whom he filed an accounting in 1724. Accomack court records state that Thomas was made guardian for these orphans of Dorothy Wainhouse on her marriage. Dorothy was Francis Wainhouse, Sr.'s sister. She was probably the first guardian after his death and she married about 1715. The Accomack records do not say 'why' Thomas Marshall was named, but it appears he married Patience about 1718-19.
Patience also named her grandson, Esme Baily, son of Edmund and Rose Bayly, in her will (although Isma Bayly was her great grandson by her granddaughter, Rose Fisher) and Thomas Marshall was Isma Bayly's guardian at the death of his father, Edmund Bayly in 1751. The administration of Thomas Fisher's estate was granted to Patience on behalf of herself and her children in 1709. Records show that Maddox Fisher was the son of Thomas Fisher; however, the names of any siblings are not provided. The use of the word "children" in the administration indicates more than one. A Tabitha Johnson, wife of John d. 1754, named her son Ismy; neither Tabitha Johnson nor Ismy Johnson were named by Patience (John predeceased and Tabitha's date of death is unknown) but there were many relations between the Marshalls and Johnsons. In addition, Patience's son, Francis Wainhouse married a Bridget Johnson.
Patience named her children by Thomas Marshall in her will, including Esme Marshall, their eldest son. Based on approximate dates of birth for Maddox Fisher, Sr., the probate for Thomas Fisher's estate and marriage to Francis Wainhouse, Sr., Patience was probably ten or so years senior to Thomas Marshall. She would have married at about age 15 had children in her late 30's and lived into her 80's.
Patience's maiden name is not known. She signed her mark "V."

Mary(wife of Francis Allen). William died 1790 in Worcester Co., MD. William took the Oath of Allegiance in Worcester
Co. in 1778 before the Hon. Nehemiah Holland. He rendered patriotic service by supplying corn for the use of the military on February 20,
1780 and July 10, 1780, and by supplying beef on October 10, 1781. He served as Sheriff of Somerset Co. 1755-1758, Justice of Worcester Co.

His father left him law books, large Bible and Common Prayer Book. The property, land and tenements at Nassawattix Neck, Worcester County and personal estate were to be divided by the children of Mary Allen after her death. William also received lands called Africa of America, Greens Chance, Cork and Kingsale.

He married twice. He married Mary Nairn about 1745. Mary was born in Somerset Co., MD before September 22, 1732. Mary was the daughter of Robert Nairn(II) and Jannet Watts. Mary died before April 18, 1767 in Worcester Co., MD. Mary was named in the will of her grandfather in 1732 and by her cousin, Francis Drummond, in 1741. Her father only named two of her children in his 1761 will (Robert Henry Marshall and Elizabeth Marshall). Mary was not named in the Tri-Partie deed by her mother in 1767. In his 1771 will, John Nairn named the children of his sister Mary, but did not name her specifically. A deed for "Hog Quarter" abstracted by Ruth Dryden shows Esme Marshall and his wife Mary and that Mary was under age. It appears Mary Nairn died before September 1, 1764, the date of the deed for "Hog Quarter."
He married Mary Brittingham in Worcester Co., MD, about 1764. Mary was the daughter of Elijah Brittingham and Sarah Newbold. She was called Mary Brittingham in her father's will. Esme Marshall and his under age wife, Mary, sold "Hog Quarter" for 5 shillings to George Layfield and John Nairn. Layfield and Nairn would have been relations to Esme's wife, Mary Nairn. Esme's first wife, Mary Nairn, would not have been under age in 1764. Mary Brittingham may have been Esme's second wife.
Esme's three children not named by his first wife's brother may have been by his second wife, Mary (Brittingham): George, Priscilla and Isme.
Esme was the eldest son of Thomas Marshall and shown as Ishmael on some documents. (Northampton Orders 1732-1742, pp. 405, 443; Accomack District Court Orders 1789-1797, p. 300, copied by James Marshall) He was in Worcester Co., MD by 1760. On 1 Sept 1764, Esme and Mary** sold 250A of 'Hog Quarter' to George Layfield and John Nairn for 5 shillings, Mary was under age. In 1767, he sold 269A in Northampton and purchased 'Rudder' at Pitts Creek Hundred. Esme's son, Thomas, bought 'Rudder' from Esme in 1772. 'Rudder,' 'Brittingham's Chance,' and 'Brittingham's Addition,' were all acquired by Esme from the widow of descendants of Elijah Brittingham. (Ruth T. Dryden, Land Records of Worcester Co. MD, pp. 75, 134, 394, 533)
**The land abstract for 'Hog Quarter' shows Esme and wife Mary sold...she was under age. Mary Nairn was named by her grandfather in 1732, so she could not have been under age in 1764. It is suspicious that Mary Nairn died by 1764 and Esme married a second time to a Mary, possibly Mary Brittingham, daughter of Elijah.
Mary Nairn is not named in the tri-partie agreement before the marriage of her mother, Janet Nairn, to Jabez Pitts, nor is she named in the 1771 will of her brother, John.
The 1771 will of John Nairn, Mary's brother, provided the names of Mary and Esme's children, as Esme died without a will. Bonds were posted 5 Oct 1784 for the administration of Esme's estate in Worchester Co, MD by George Marshall, Thomas Marshall and John Marshall rejected the administration. Thomas and John Marshall provided inventory and the next of kin were listed as Levin and Theophilus Marshall.(Ruth Dryden, Worcester Admin. Bonds & Inventories, p. 15)
John Nairn named the children of his sister, Mary: Thomas, John, Robert and William.
NOTE: The George Marshall who administered the estate is probably the same George Marshall for whom Thomas, son of Esme, holds a mortgage in Worcester County. He is not named in the will of John Nairn as a child of Mary Nairn, nor is he named in the will of William Allen. Patience Marshall who married William Waller is not named by John Nairn or William Allen. George and Patience might have been children from Esme's second marriage; George may have been a child of the second marriage and Patience deceased by 1771. That they were children of Esme is not proved and based in large part on the names of their children--George Esme Marshall and Esme Marshall Waller.
The 1810 census of Worcester County shows what looks like Isme or Ismel Marshall as 45+ with one female 10-16 and one female 26-45. If this is Isme, he is too old to be Esme's grandson. Again, neither John Nairn nor William Allen named an Isme/Esme in their wills.

Court record of May 12, 1742, Northampton Co., VA: "Account of sale of the estates of Anne & Hezekiel Tilney Orphans was returned sworn to by Thomas Marshall, Gent., their guardian and orders to be recorded. She married Robert James in Northampton Co., VA, June 5, 1751. Robert was the son of Thomas James. Robert died 1759 in Northampton Co., VA. Robert James married 2nd Elizabeth Christian.

He married Sarah Darby in Northampton Co., VA, about 1750. His father's 1761 will left him and his brother, Esme, land in Nasswadox Neck between Ouchanock and Nasswadow Creeks, beginning at the south branch of Marshall's creek at a marked tree in field which Thomas John was then planting, not molesting the 100A which was given each son by deed of gift, but including that in the whole land and 500A bought of Abner Brickhouse on sea-side known by name of Brickhouse's Marsh; neither to sell to an outside person but must sell to the other brother.
Thomas John was Sheriff and Justice of the Peace for Northampton Co VA. He purchased 500A 'Carthagena' on a branch of Secretary Creek near New Market. (James H. Marshall's research from Dorchester Deeds HD 30, p. 113, Minutes, p. 108, 1783 tax list, Great Choptank Parish Records, Deeds HD4, p. 592; Robert K. Headley, Jr., 18th Century VA Newspapers, p. 38)
His purchase of "Carthagena" on June 25, 1768 is the earliest record of his being in Dorchester County. (Notes of James H. Marshall from Deeds Old 22, p. 386) It is presumed most his children were born in Northampton County, VA.
Thomas John married Sarah Darby, bond dated 12 February 175_, secured by Thomas Barlow. (Stratton Nottingham, Marriage License Bonds of Northampton Co. VA 1706-1854)
His will is dated March 13, 1773 and proved May 6, 1773, Dorchester Co., MD. He named wife, Sarah, and son, John, as executors. He left the north side of easternmost branch to John and south side of branch to Theophilus. If John dies without issue or before he sold, then to Levin. If Theophilus died without issue or before he sold, then to Henry. If John and Levin died without issue or before either sold, then to James. If Theophilus and Henry die without issue or before they sold, then to James. After wife's death, his moveable estate was to be equally divided among his eight children: John, Theophilus, Patience, Sarah, Leavin, Mary, Henry and James; John and Theophilus not to have any part of the Negroes. Wit: John Anderton, Thos. Muir, Bartholomew Adams. Estate presented July 27, 1773, settled November 29, 1773: appraisers were John Dickenson and John Anderton; creditors were Henry Hooper 2nd and Henry Steele; next of kin was John Darby; executor John Marshall; L739.19.2 (DO 115.222)

This was land Philip Fisher had bequeathed in 1702 to his sons, John, Thomas and Philip. That same land was sold in 1769 by Thomas Marshall's sons, Esme and Thomas John. (Ralph T. Thomas Marshall was shown as guardian to Francis and presented inventory and appraisal on 3 February 1724, Accomack Court. A search of Marshalls in KY in 1820 shows no Esme, E.P., or Erma (the names as indexed in later census). Because the name is so rare, Esme P. Marshall of Daviess County could be the son of Esme of John D., who would have been age 20 when Esme P. was born.

She married William Cottman Waller about 1764. William was born in Somerset Co., MD October 14, 1743. William was the son of Richard Waller and Ann Cottman. William died 1774. There is no definitive proof that William Cottman Waller's wife was the daughter of Esme Marshall. Esme Marshall died intestate and his children thus far identified have been through wills or documents of other family members, such as Mary Nairn's brother, John. John Nairn died in 1771 and named his sister's children. He did not, however, name Patience. After basing a relationship from Esme Marshall to Esme Marshall Waller purely on the given names and dates and assuming Esme Waller's mother was a daughter of Esme Marshall, Vern Skinner found a notation in Charles S. Waller's "The Chesapeakers" that William Cottman Waller married a Patience Marshall. The theory still holds and is now even more enhanced that this daughter was named after Esme Marshall's mother.

No further information on George or George Esme Marshall has been found. William Allen and John Nairn, when naming children of Esme or Mary Nairn Marshall do not name a George. He may have been the son of Mary Brittingham.

Thomas married Esther Marshall on March 25, 1766 in Somerset Co., MD. Esther Marshall was born January 6, 1748-9 Somerset Co., MD, the daughter of Thomas Marshall and Jane. Thomas and Esther Marshall had at least three children whose births were recorded in Coventry Parish records, Somerset Co., MD. Thomas was named father of Mary Marshall in the will of Mary's grandfather, Thomas Marshall, dated April 24, 1786 Somerset Co. MD. Thomas bought land in Worcester Co. MD in 1768 and either bought or was given other parcels in that county in 1771, 1772, 1773 and 1786. The John Drummond Marshall prayer book: Records recorded by John Drummond Marshall in his prayer book were transcribed and filed at the Maryland Historical Society, Baltimore, MD, and later the prayer book itself was given to the Society. John Drummond Marshall recorded his first marriage, births of his children, brother-in-law and 1st wife's deaths in the prayer book. He (or the next owner of the prayer book) then devoted all other records in the prayer book to the lineage and descendants of Mary Marshall, his niece, daughter of his brother Thomas. Entries were made to the prayer book after John Drummond Marshall's death in 1800 regarding the marriage of Mary Purnell to Levin Stewart and the births of their children, indicating the prayer book's possession may have passed to Mary Marshall Purnell and/or her daughter, Mary Purnell Stewart.

He married Esther Fountain Hall in Somerset Co., MD, July 11, 1803. Esther died 1815 in Somerset Co., MD. The marriage record shows Esther with surname Hall. Robert calls her Esther Fountain in his will. No marriage record has been found of an Esther Fountain to a Hall; however, it is suspect that she was the widow of a Hall related to Robert's daughter-in-law, Elizabeth Hall, or the widow of one of the sons of William Hall (Isaac, Levi Wood or John) who lived next to the Marshalls at "Pimore."
He made a will in Somerset Co., MD, May 26, 1814. Robert and his family lived at "Tarso", inherited from his uncle, John Nairn in 1771. "Tarso" was located west of the Pocomoke River (a little over a mile) and about two miles south of the Rehobeth Plantation. It adjoined "Pimore" and "Nairn's Addition" and bordered "Late Discovery" on the southern line. (about half-way between the towns of Rehobeth and Shelltown and Rehobeth Road probably runs through the old property) Robert is shown paying the 1783 taxes. Members of the family continued at "Tarso" until Robert's grandson sold it to Isaac T. Marshall. (notes of William Marshall Scott & C. Hayward Marshall, Sr.)
1810 census shows him at Pocomoke Hundred, Somerset as 45+, with 1F10-16, 1F16-26, and 1F45+. Ennumerated on either side are Isaac Riggin and Noah Riggin, Martha Hall, Sarah Riggin and then the household of his son, Robert N. Marshall.
A Robert Marshall was a Private, Somerset Militia, Princess Anne Battalion, St. Asaph's Co., 1780. He took the Oath of Allegiance in Worchester Co. in 1778 before the Hon. James Selby. (Henry C. He married Elizabeth Sherwood before 1779. Elizabeth was the daughter of Philip Sherwood and Elizabeth Dawson. Elizabeth died after 1803. Theophilus gave a deposition in 1802 that he was aged 47. (James Marshall's notes: Dorchester Deeds HD 20, p. 113, 1802) 1778 Chancery Court June 23, order to pay and receipt by Theophious Marshall on account (MSA S 1004-12-2963 MdHR 6636-11-137/49) Theophilus and Levin were named "next of kin" in the administration of their uncle, Esme's, estate, 1784 Worcester Co., MD. He applied in March, 1787 for a license to keep an ordinary at his house in New Market. (James Marshall's notes: Dorchester Minutes, p. 108, March, 1787).
The 1783 Dorchester tax list shows that he and John were in possession of a tract of land in the Middle District called "Carthegenia Point." 1783 Dorchester Tax List shows him with "Marshalls Chance," "Marshalls Venture," 36 3/4A "Cartheginea" all in Middle District. He is shown as 'agent' for James Marshall for land in Middle District.
Theophilus was among residents of Vienna, MD who signed a petition presented in October, 1780: "situation of town and probably return of enemy crews from NY cause apprehension; aid from the state has been wanting; Tories on island gave aid to the enemy; ships in the stocks are objects of plunder; lower Dorchester, Somerset & Worcester are also threatened; when defense of the Bay is undertaken, inlets and rivers should also be defended; cannon should be sent; 6 pieces already in government hands would be a desirable addition here." (Dorcester County Maryland Genealogical Magazine, Vol. III, No. 6, March, 1984, p.17)
Theophilus appears in the 1790 census of Dorcester Co. with 2 males +16, 3 females -16, 4 females +16, and 9 slaves. There is a fifteen year difference in age between Theophilus' two known sons. It is not known if Elizabeth Sherwood is the mother of William Marshall.

1800 census, Dorchester Co., MD: Theo. Marshall 3M-10, 2M10-16, 1M16-26, 1M45+, 2F10-16, 1F16-26, 1F26-45, 10 slaves. In 1804, Theophilus recovered lands of Thomas Marshall (son of his brother, John), which had been sold for debt. 1805 deposition of James Condon regarding a contract between Peter Rea, deceased, and Theophilus Marshall.
The "Republican Star" reported on July 12, 1808 that their was mail at the Cambridge post office for Theophilus and William Marshall. (F. Edward Wright, MD Eastern Shore Newspaper Abstracts Vol. 2, p. 42)
No death record has been found for Theophilus and he is not found in the 1810 census. His only known children are William and John; however, his 1790 and 1800 household suggests he had other children.

He married three times. He married an unknown person. He married Mary (Ennalls) Hooper in Dorchester Co., MD, December 13, 1790. Mary died before 1803. It is not proved that he is the Levin who married Mary Hooper. She was the widow of Henry Hooper. A marriage record for Mary Ennalls to Henry Hooper is dated 4/14/1783. It is not clear when she died, but appears her estate was in Chancery Court in 1822, probably because of the death of Levin in that year. Her heirs are apparently children by Henry Hooper.
He married Margaret Vickers before 1803. It is NOT proved that Levin of Thomas John is the same Levin Marshall d. 1822 who married Mary Hooper and Margaret Vickers.
Levin is cited in the household of his brother, John, in 1783, for whom John is assessor and agent for Levin on land in Middle District, Dorchester Co. Tax List. Levin is listed as next of kin, along with his brother, Theophilus Marshall, at the administration of the estate of Esme Marshall, their uncle, on October 5, 1784, Worcester Co., MD. 1790 census shows a Levin Marshall, p. 57, Dorchester Co. MD 1M16+, 1F, and 10 slaves. This Levin Marshall is two pages away from Theophilus Marshall. In 1799, Levin and Henry bought a lot in East New Market. In 1799, Henry Marshall sold furniture. It is thought that Levin is the Levin who married December 13, 1790 Mary Hooper (Great Choptank Parish records). Mary was the widow of Henry Hooper and may be Mary Ennalls who married in 1783 Henry Hooper. A Levin Marshall's tombstone shows birth in 1756 and death in 1822 and is next to Margaret Marshall 177_-1822. It is not proved this is Levin of Thomas John. After the death of Mary (Ennalls) Hooper, it is thought he married Margaret Vickers.

A Levin Marshall married Rosanna Stokes April 30, 1785; he died by June 3, 1800, when "The Republican Star" reported her administration of his estate (F. Edward Wright, MD Eastern Shore Newspaper Abstracts Vol. I, p. 60). Rosanna Marshall is in the 1800 and 1810 census of Dorchester in close proximity to the Neck District Marshalls. This is not the correct Levin Marshall.

He could have been under age or deceased. However, the appearance of a Henry Marshall with Levin in 1799 certainly indicates this Henry Marshall in E. New Market is the son of Thomas John.

Accomack Co., VA. Maddox is named as a local heir of Thomas Dolby and would, therefore, be a descendant of Thomas Dolby's sister,
Susanna. Ismy Fisher's brother, John, had a son named Maddox; it appears he stayed in Kentucky. Ismy's brother, Thomas, did not name a son
Maddox in his 1789 will. It is assumed that this Maddox Fisher was the son of Ismy by a marriage previous to Margaret Hall.
Maddox served in the Revolution. He stated on August 28, 1832 that he enlisted in a company of militia commanded by Capt. William Christian in January, 1777 and remained about two years and then went to Accomack County to live and was enrolled in a militia company commanded by Capt. William Justice January 1, 1779 and continued in said company until the end of the war. He gave his birth as June, 1759. (notes of M.K. Miles)

1762, George Dashiell is named next of kin in prerogative court records for the estate of Thomas Marshall (circumstantial evidence shows Thomas Marshall his uncle).

George was Sheriff of Somerset Co. 1770-1773, County Court Justice 1775-1777, Judge of the Court of Appeals for Tax Assessment 1786. He was a Colonel, Somerset Militia January 6, 1776; County Lieutenant July 1, 1777 to at least July 24, 1780. He was appointed as Collector of Clothing for the American Army in Somerset Co. on November 27, 1777, and Commissary of Purchaes in 1780. He attended the MD Conventions in 1774, 1775 and 1776, and signed the Association of the Freemen of Maryland on July 26, 1775. He took the Oath of Allegiance in Somerset Co. He made a will in Accomack Co., VA, December 18, 1756. Edmund's will was probated in Accomack Co., VA, January 26, 1757. The tomb of Thomas Fisher shows his mother to be Rose Fisher, daughter of Maddox. The tomb also shows his father as Edmund, grandfather Edmund and great grandfather as Richard Bayly of Craddock. His wife's brother, Americus Scarburgh, was named guardian for Edmund's son, Thomas, infant heir at law. Tabitha Gilchrist, Edmund's sister, was a witness to his will. (Stratton Nottingham, Wills & Admin. Acc. Co., Ralph Whitelaw, VA Eastern Shore, p.980). The widow, Dorothy, married John Custis and had a son, Henry Custis.
Dorothy Scarburgh named her grandson, Henry Custis, in her 1775 will. She did not name any Bayly grandchildren. With the information from the tombstone (Ralph Whitelaw, VA Eastern Shore). (notes of Cynthia McDaniel shows a daughter, Dorothy Wainhouse Bayly)

65. Esme4 Bayley (Mjr.) (Rose3 Fisher, Maddox2, Patience1 "V") was born December 27, 1740. Esme died November 10, 1801 in Somerset Co., MD.
He married Sinah Polk before 1773. Sinah was the daughter of David Polk and Elizabeth "Betsy" Gillis. Sinah died 1803 in Somerset Co., MD. She made a will in Somerset Co., MD, July 18, 1802. Sinah's will was probated in Somerset Co., MD, September 13, 1803. Sinah Bayley is named in the 1773 will of Betty Dulaney, along with James Polk, Sr., Patience Bayley and Betty Bayley; witnesses were William Polk, David Polk and Gillis Polk. (Neil Keddie, Somerset Co. MD Wills Liber EB#5, f.50)
She named her brothers: Josiah Polk, James Polk and William Polk. She named a grandson, James Bayley, but did not give his father's name. Thomas Marshall was named guardian for Patience's grandson 1 May 1751. Will dated May 4, 1799 names wife Sinah, sons Thomas, Henry, Josiah and daughter, Peggy. Esme owned "Addition to Flower Field" between Wicomico and Quantico, "Rye Rains" in Rockawakin, "Hogsdown" and "Goodwill" and two lots in Princess Anne. (Somerset Co. MD Wills EB23, Ruth Dryden) Esme was the first Registrar of Wills in Somerset County and held that position for many years. Under his administration, all the loose probate records were recorded into bound volumes.
It appears that this is the same Esme Bayley who is shown as Sheriff in Worcester Co., MD, 1766 and 1768 land records. This Esme Bayley in Worcester patented 112 acres August 5, 1751 "Batchellors Lot," which he sold in 1767 to Samuel Handy and purchased from Samuel Handy March 6, 1771. On August 12, 1756, Esme Bayley and Ezekiel Selby purchased land at "Benefield." In 1766, Esme purchased land at "Ephraim's Purchase."
Esme took the Oath of Allegiance in Somerset County in 1778 before the Hon. Levin Wilson, and served in the Revolution as a Major of the Somerset Militia, Salisbury Battalion, August 30, 1777. (Henry C. Peden, Revolutionary Patriots of Worcester & Somerset Counties MD 1775-1783)
Isaac W. K. Handy, in "Annals and Memorials of the Handys and Their Kindred" notes a Major Esme Bayley of Somerset Co MD (uncle of Col. Thomas Bayley of Accomac Co. VA, m. Unknown Polk, sister of Gilliss Polk and Judge William Polk) and had children: Henry E. Bayley, Josiah Bayley, Thomas Bayley, James Bayley, and Patience Bayley. The relationship of Esme Bayly to Thomas of Accomac, combined with tombstone and other records found in Whitelaw's VA Eastern Shore has been used as a basis for this Bayly family.
