made and agreed Between Nathaniel Bibby of Frederick County in the Colony of Virginia of the One Part and Capt. Thomas Swearingen of the same County and Colony of the Other Part. (Dated August 3, 1748)

Bibby } Articles to } of Swearingen } Agreement

ARTICLES of Agreement made and agreed Between Nathaniel Bibby of Frederick County in the Colony of Virginia of the One Part and Capt. Thomas Swearingen of the same County and Colony of the Other Part. Witnessoth that the said Nathaniel Bibby doth Covenant and agree to and with the said Thoimas Swearingen his Heirs asigns that he the said Nathaniel Bibby his Heirs Executor Administrators shall allow give grant and confirm unto the said Thomas Swearingen his Heirs or asigns one full half of all the Estate Real and Personal that shall be found in Accomack and Northampton in the Colony of Virginia of ;the Estate of Edmond Bibby Deceased or any other Estate debts dues or Demands that have or shall become due to of said Nathaniel Bibby as Heir at Law to Edmond BIbby Deceased and if required upon an Equal Division of the lands to made does Execute or cause to be made done executed or suffers and any deed or deeds seals or releases or any other lawful Conveyances wherby he the said BIbby is able to give. And Safely to deliver all writings that belopng or anyway concerns the aforesaid Estates together with all sufficient Power of Attorney as he the said Bibby is capable of giving and that said Thomas Swearingen doth Covenant and agaree with the said Bibby to be at his own expense and also to pay all costs and charges that of said Swearingen shall be at in the recovery of the aforesaid Estate without charging of said Bibby or burdening of Estate with it or claiming antthing more than what is before mentioned in the said Article of true performance of which each bindeth himself unto the other as appears by Bonds Bearing Datae with these presents In Witness where of the parties hath interchangably set their hands and affix'd their Sealls this third Day of August Domini One Thousand Seven Hundred & forty Eight
